What gestational surrogacy involves

Gestational surrogacy is the current standard in fertility medicine. The surrogate carries an embryo created from the intended parents' or donors' gametes and has no genetic relationship to the child. Traditional surrogacy, in which the surrogate provides the egg, creates complex legal and ethical considerations and is not offered by established fertility programs.

How the surrogacy process works

An egg retrieval cycle is completed by the intended mother or egg donor. Resulting embryos are frozen for a future transfer or used fresh. The surrogate undergoes uterine preparation and receives the embryo transfer. If successful, she carries the pregnancy through to delivery.

A legal agreement governs the arrangement throughout the pregnancy, covering responsibilities, parental rights, and decision-making. Surrogacy by country: legal status and key differences

Surrogacy is one of the most legally variable fertility treatments. The country you choose determines whether commercial surrogacy is permitted, how parental rights are established, and what protections exist for all parties involved.

Mexico has no federal surrogacy law, but a 2021 Supreme Court ruling established surrogacy as a constitutionally protected right and confirmed that no state can prohibit it outright. Regulation is managed at state level. Sinaloa and Tabasco have explicit surrogacy legislation; Mexico City and Quintana Roo handle cases through court proceedings. International intended parents of all backgrounds, including same-sex couples and single parents, have successfully completed arrangements in Mexico.

Cyprus permits altruistic surrogacy under a defined legal process. Intended parents must meet eligibility criteria and obtain a court order recognizing parental rights before birth. English-language legal support is readily available for international patients.

Thailand restricted surrogacy in 2015 under the Protection of Children Born by Assisted Reproductive Technology Act. Commercial surrogacy is prohibited, and altruistic surrogacy is limited to close-relative arrangements under specific conditions. International patients do not have access to surrogacy services in Thailand under current law.

Denmark does not legally recognize surrogacy. Commercial surrogacy is prohibited, and there is no regulatory framework for altruistic arrangements. Danish intended parents who pursue surrogacy abroad may face legal challenges establishing parental rights upon return.

Malaysia has no legislation governing surrogacy agreements and no mechanism for establishing parental rights through a surrogate arrangement. Patients resident in Malaysia who pursue surrogacy abroad should obtain legal advice about recognition of parentage before starting.
